What if I have $60k+ student loans, $14k credit cards spent on medical bills, etc., from the last few years of waiting on disability? What do I do? They may see obvious ways you can cut your spending that you may have overlooked, for example. Their extensive knowledge of debt relief options also makes them ideal mentors for consumers who need professional help when it comes to assessing their debts and figuring out a plan that will work.

Consumers can apply for a debt management plan regardless of their credit score. Once they set up an initial consultation with a credit counseling agency, they will go over the details of their debts and their income with their agency who will come up with an action plan on their behalf. If the consumer decides to move forward with a debt management plan, it can take a few hours or a few weeks to get started. “Once the recommendation for a debt management plan is made, it’s up to you to decide how quickly to enroll,” said McClary.
Home equity loans involve borrowing a fixed amount of money based on the equity in your home. As a simplified example, if your home is worth $100,000 and you owe $50,000 on it, you might be able to borrow between $30,000 and $40,000 in equity. so to ease my stress, which ironically is a major component in my disabiiity, after I fill out their financial affidavit, I am assuming I won’t have to worry about them pounding on my door and taking our furniture? My 2013 tax statement Chase bank had sent me a 1099 C for over 20000 – with that when the acct tallied…..he still came out with an insolvency of over 49000 – this all happened rather fast as was not aware my depression also created a bipolar II disorder which is how I accumulated so much debt in such a short time – termed as “manic sprees” – to think I once was a high risk collector and i heard this term at least 2x a day and did not believe……..what is that they say about what goes around? Statute of Limitations with no signed agreement in Fl is 4 yrs..last time I had paid the “creditor” on this one was Nov 2011 – however I see another sitting in collections from Portfolio that says last py was 3/2011 and another from Unifund where lst pymnt was feb 2011 – statute expired…..would I call Transunion?

The big downside is, if you need to leave your job for any reason, including if you're terminated, you must pay back the 401(k) loan quickly -- often within 60 days. If you don't, the unpaid loan is treated as a taxable distribution and you'd have to pay a 10% penalty. Not only can a 401(k) loan trap you in your job, but you could also hurt your retirement savings goals, because you'll have less money invested and growing. 


If you cash in your IRA early, you will not only pay taxes on it (unless it is a ROTH), you also pay a 10% early withdrawal penalty. That means that money is not going to go very far. Before you use your retirement money to pay off consumer debt, I would suggest you at least talk with a reputable credit counseling agency to see if there’s a way to get out of debt without using this money that you will no doubt need when you do retire.

Finally, if you or the credit counseling agency fail to make payments on time under the debt management plan, those late or missed payments will appear on your credit report. Because your DMP can cover many debts, one late payment to the credit counseling agency may be reflected as a late payment for each account that is part of the DMP on your credit report. A late payment will also harm your credit scores.

DMP: If you search the internet for “debt management plan,” you’ll come up with perhaps hundreds of companies and non-profit agencies willing to help you formulate a debt management plan. Some of these are for-profit companies, and some claim to be non-profit. Your best bet is to go with an affiliate of the National Foundation for Credit Counseling, which is truly non-profit, experienced, and respected. The NFCC website has a search function that will help you find an affiliated agency, or search for Consumer Credit Counseling of [your city or region].

I recently became fed up with the credit card debt that I have been carrying for 6 years and have *finally* taken action to eliminate it, such as making a budget (and sticking to it!), trying to negotiate a lower APR rate, selling stuff (au revoir, gitane bicycle) and making additional payments on my credit cards. I had credit card debt and I used Credit Advocates to help with the solution. Now that I am at the end of paying off the debt I just wanted to cry when I saw how much I was charged in fees – it was a fee for everything including phone calls made for me. At least between a forth and half of the monies sent went to them. If I had it to do over again I would call the credit card companies and try to repay the lesser amount over time. It seems to me that the companies that say they can help are only there to take your monies at a very high rate of fees, etc.

You should compare that information to what’s in our monthly progress report and ensure that everything matches. Don’t be afraid to have many budget categories. It will help you have a greater understanding of where things are going. Some regular expenses include internet, cell phone, household goods, medical costs, pets, haircuts, car repair, and home repair. Not every item will have an expense every month, but by setting some money aside for those irregular expenses, you’ll be ready when they hit.

Unsecured debt such as credit cards and medical bills are, by far, the most common debts associated with debt management programs. Utilities, rent and cell phone services are other types of unsecured debt that could be part of a DMP. Some installment contracts, such as country club or gym memberships also could be eligible. There is no hard-and-fast rule for how far in debt you must be to get in a program, but most creditors and legitimate credit counseling agencies say your financial situation needs to be severe. In other words, you must owe more money than your income and savings can reasonably handle. Secured debts, such as a mortgage or auto loan, are not eligible for the program.
