Chapter 13 is typically more expensive than Chapter 7 but I can’t give you a specific total cost for either. It will vary. Your best bet is to talk with a consumer bankruptcy attorney. If you can’t afford to file now, the attorney should be able to help you figure out other options. Keep in mind that they are used to seeing consumers who are at the end of their rope financially, so it’s not something you should be embarrassed about.

Today, I have no consumer debt. By choice, I’m not debt-free. I do have a mortgage on my primary residence even though I could pay it off. I also did not pay off my student loans early. In these cases, I’m using debt conservatively and consciously to advance my financial goals. But all the nasty stuff—credit cards, personal loans, and an auto loan—is long gone.
Why don’t you qualify for IBR or PAYE? Is it because your income is too high to reduce your payments? If that’s the case, and you’ve exhausted all your options, then I am at a loss in terms of what to suggest other than to encourage you to continue to pay as much as you can and check back into those programs from time to time to see if requirements have changed. Student loan debt is an enormous problem and for many there is no simple solution.

Chapter 13: Yes. Chapter 13 also discharges debts, but many of the nondischargeable debts like recent taxes and past due child support must be paid in full in the Chapter 13 plan. Unsecured debt like credit cards will only be paid in a Chapter 13 plan if you have the income to cover it. Sometimes unsecured creditors receive a portion of their debt and sometimes they receive nothing at all. But even if they’re not paid they’ll be discharged if you complete your plan. Contact your bank and stop payments to the agency servicing your debt management program as soon as you become aware the agency has shut down. You should immediately contact the creditors involved and ask if you could continue paying them directly or would they work out another payment plan. Also, ask for a credit report and verify that previous payments you made to the DMP agency were sent to your creditors. If payments were missed, there could be some negative consequences to your credit score. Finally, you could contact a nonprofit credit counseling agency and ask them to intervene on your behalf with your creditors.
Find a good credit counselor. Almost all DMPs are administered by consumer credit counseling agencies--so much so, in fact, that the terms "credit counseling" and "debt management" are often used interchangeably. Thoroughly researching the agency is the most important thing to do before deciding to enroll in their debt management program. This account will be opened in your name with you having ultimate control over its funds. The monies collected in this account get disbursed only at the time a negotiation is reached with the creditor and you agree with the settlement offer.
A credit counselor is a professional who can advise you on how to handle and successfully pay off your debt. A simple call to a credit counseling agency for a consultation won’t impact your credit in the slightest. But if the credit counselor or agency enrolls you in any kind of consolidation, repayment, or management plan, that could affect your credit.
