Statute of Limitations with no signed agreement in Fl is 4 yrs..last time I had paid the “creditor” on this one was Nov 2011 – however I see another sitting in collections from Portfolio that says last py was 3/2011 and another from Unifund where lst pymnt was feb 2011 – statute expired…..would I call Transunion?

While your credit score may suffer if you’re falling behind on monthly payments before you get your debt management plan set up, starting your plan should provide some relief. Your credit score should increase as you begin making regular monthly payments and your debt balances drop. Experian does note that you may see some negative side effects when accounts are closed, usually due to changes with your credit utilization rate or credit mix.

Kevin – Let’s look at it this way. You’re paying roughly $3600 a year in interest on that debt. Over five years that’s a little over $18,000. The counseling agency can get that down to 0 (you won’t even find a debt consolidation loan for that rate) and you’ll be debt-free at the end of those five years. The damage to your credit won’t be anywhere near what it would be with debt settlement.
Second, there's no guarantee that creditors will accept a partial payment. They may refuse any terms that a bankruptcy alternative proposes, leaving you potentially in worse shape than when you began. Finally, late fees and interest accrue on unpaid balances. That's money you'd have to pay, on top of any exorbitant fees the credit agency itself may be charging.

With debt settlement, your attorney will ask you to stop making payments to your creditors and instead, contribute money on a regular basis to a fund.
